Please read these Terms of Service (“Terms”) carefully before using Listpoint.ca (“Service”, “we”, “our”, or “us”). By accessing or using this Service, you agree to be bound by these Terms and our Privacy Policy. If you do not agree, do not use this Service.
1. About Listpoint.ca
Listpoint.ca (“Service”) is owned and operated by K2 Realty Corporation, of which Dan Royer, a licensed real estate agent in the province of Alberta, is an owner. Dan Royer is licensed through the brokerage INITIA Real Estate, which does not own K2 Realty Corporation or Listpoint.ca.
For the purposes of these Terms of Service, “Listpoint.ca”, “Service”, “we”, “our”, or “us” refers collectively to:
Listpoint.ca, the website and service itself
K2 Realty Corporation and any parent, subsidiary, or affiliated companies
Dan Royer, in his capacity as owner of K2 Realty Corporation and as a licensed real estate agent
INITIA Real Estate, the brokerage through which Dan Royer is licensed
All officers, directors, shareholders, employees, agents, contractors, representatives, and affiliates of the foregoing
By using this Service, you acknowledge that all of the above individuals and entities are fully protected under these Terms of Service, including all disclaimers, limitations of liability, and indemnification provisions.
2. Eligibility
This Service is available exclusively to homebuilders/developers listing newly constructed homes or condos. By using this Service, you represent that you meet these eligibility requirements.
3. Homebuilder/Developer Responsibilities
As a homebuilder/developer using Listpoint.ca, you agree to the following obligations:
Provide accurate property information — including full construction blueprints, property measurements, bedroom/bathroom counts, and any documentation required for MLS® compliance.
Provide property visuals and descriptions — including photos, virtual tours, 3D renderings, or other images representing the property.
Maintain control of the sales process — handle inquiries, showings, offers, and negotiations. Listpoint.ca does not manage these processes.
Buyer-agent commissions — while MLS® rules require a commission offer, you retain full control of the amount and negotiation. No commission is owed for unrepresented buyers. The buyer’s agent’s brokerage invoices you directly.
Update listings as necessary — including price, possession date, property details, or status changes.
Notify upon sale — within 24 hours inform us when your property is sold or under contract and provide copies of executed purchase agreements and amendments.
Ensure legal compliance — including disclosure of material latent defects, condo documentation (if applicable), and MLS® rules.
Indemnify Listpoint.ca — hold harmless for any claims arising from your listings, representations, or conduct.
Acknowledge limited brokerage obligations — understand that Listpoint.ca and the submitting brokerage:
Do not represent you as a seller
May represent buyers interested in your property
Will post and update your MLS® listing
Will forward inquiries, but will not provide advice, negotiate, or hold deposits
By using this Service, you accept full responsibility for your property, listings, and interactions with buyers and agents.
4. Brokerage Obligations
Listpoint.ca and its associated brokerage will:
Post your property to the local MLS® system and REALTOR.ca
Forward phone, text, and email inquiries received from your listing
Update MLS® information for price changes, status changes, and sold properties
Report the sale date, selling price, and possession date to MLS®
Note: The brokerage does not provide pricing guidance, marketing, negotiating offers, holding deposits, conveying deals, or creating content or visuals for listings.
5. Notices and Communications
Notices: By using Listpoint.ca, you consent to receive notices from us via email, phone, voicemail, text message, mail, website banner, or pop-up.
Consent to Communications: You agree to receive communications regarding updates, surveys, promotions, offers, and announcements. You may opt out at any time by contacting support@listpoint.ca.
6. Fees
Fees are non-refundable and may vary by market area.
Payment is due upon invoice.
7. Intellectual Property
All copyrights, trademarks, logos, and content on Listpoint.ca are owned by us or licensed to us, including CREA trademarks. Use is limited to accessing and posting listings as authorized. Any other reproduction or use requires written permission.
8. Prohibited Activities
Users may not engage in:
Illegal activities, malware distribution, or unauthorized access attempts
Automated scraping or copying of content
Posting false, misleading, obscene, or offensive material
Discrimination, harassment, defamation, or threats
Using the Service to infringe on third-party intellectual property
Misrepresentation of affiliation, multiple accounts, or impersonation
9. Paid Services Disclaimer
Listpoint.ca provides the service “as-is” with no warranties regarding accuracy, completeness, security, or suitability. You use the Service at your own risk.
10. Limitation of Liability and Indemnity
Listpoint.ca shall not be liable for damages resulting from your use of the Service, including property loss, disputes, errors, or commissions. You agree to indemnify and hold harmless Listpoint.ca from any claims, costs, or damages arising from your listings or conduct on the Service.
11. Termination and Changes
We may suspend or terminate your access at any time, without notice.
Service features and fees may be modified at any time.
Continued use indicates acceptance of changes.
12. Governing Law
These Terms are governed by the laws of Canada, with courts in Edmonton, Alberta having exclusive jurisdiction over disputes.
13. Additional Legal Notices
CREA Trademarks: REALTOR®, REALTORS®, and MLS® marks are owned by CREA and licensed to the brokerage.
Direct Sales: Homebuilders/developers may sell directly to buyers and manage commissions independently. Listpoint.ca does not participate in commission disputes.
Contractual Acknowledgment: By posting, you acknowledge that you are using the Service without agency representation, and that the brokerage may represent buyers.
Feedback: Any suggestions or comments submitted to Listpoint.ca may be used freely to improve the Service.
